Donald H. Fink, Jr., indicted in March 2007 by the Montgomery County Grand Jury pled Guilty as Charged to six counts.  The five felony charges and single misdemeanor charge all arise from his actions on March 13, 2007.  The defendant was found guilty by the Court on the following charges:

 

·         Grand Theft (Firearm), a 4th degree felony

·         Theft in Office, a 5th degree felony

·         Tampering With Evidence, a 3rd degree felony

·         Falsification, a 1st degree misdemeanor

·         Inducing Panic, a 4th degree felony

·         Making False Alarms, a 4th degree felony

 

On March 13, 2007, at approximately 3 a.m., the defendant, a Dayton Police Officer, while on duty and patrol, radioed that he had been shot in the chest by an unknown suspect.  Subsequent investigation by the Dayton Police Department revealed that, in fact, he had shot himself in the chest with a firearm he had stolen from the police property room.  The defendant was wearing a bullet proof vest at the time of the incident.  The defendant had previously been ordered to appear before the Internal Affairs Division of the police department, later that same morning, in regards to an unrelated investigation concerning his conduct.

 

Prosecutor Mat Heck, Jr. said, “Thankfully, this type of behavior is not typical of the police officers we trust to protect us every day.  This defendant not only violated this trust, but in lying about the events of that night, he also endangered the lives of other Dayton Police Officers and the public.  This was a calculated, planned and staged effort on the part of a disgruntled employee to earn maximum payout on a disability from a police department he wanted to leave.”
