David Paul Diamond Lovato, AKA “MJ3000”, was sentenced to an indefinite sentence of 156 years to life in the penitentiary by the Montgomery County Common Pleas Court for raping two women on January 16, 2006 in the City of Dayton.  On November 15, 2006, this defendant was found guilty as charged by a jury on four counts of Rape by Force, two counts of Kidnapping, two counts of Felonious Assault, all with sexual motivation specifications, and one count of Intimidation of a Crime Victim.

The jury also found the defendant guilty of sexual predator specifications and repeat violent offender specifications. 

During the trial, the jury heard evidence of the defendant’s lengthy criminal history.  In 1985, as a 15 year old, this defendant was convicted of Rape of a 5 year old girl.  He was incarcerated for that crime until 1988.  Within months of his release, he committed a robbery, and was sentenced, as an adult, to 3-15 years incarceration.  He was released early by the Parole Board in December 1990.  In August 1991 the defendant raped an 11 year old child, and in February 1992 he was sentenced to 8-25 years incarceration and was labeled a sexual predator. In October 2005 the Parole Board, against our repeated objections, again released him after serving just 13 years.  In January 2006, less than three months after being released from prison, he committed the rapes in this case.

Prosecutor Mat Heck, Jr. said, “It’s interesting to note that this defendant, at age 37,  has been out of prison for a total of only about 14 months since he was 15 years old.  Now, he will be imprisoned for the rest of his life, and not a threat to our community. Violent, repeat offenders must be incarcerated for the maximum time under the law.”
