Announces

Temporary Injunction and Closing Order of

Harrison Township Rental Properties

 

On April 23, 2007, Mathias H. Heck, Jr., Montgomery County Prosecuting Attorney, filed a Complaint for Abatement of Public Nuisance against the owner of the apartments located at 262 and 266 Nottingham Road, Harrison Township.  On May 2 and May 3, 2007 an evidentiary hearing was held in common pleas court.  On Tuesday, July 3rd, the Court ordered a temporary injunction and closing order for the subject properties.

 

The cause of this action is the properties are a nuisance and the owner, Barton L. Wilson of Kettering, has permitted chronic illegal drug activity and prostitution to occur there. Furthermore, Wilson has been informed on numerous occasions by the Montgomery County Sheriff’s Office of these problems.  He has continued to refuse to take any measures to correct these problems.

 

Between January 2006 and April 2007 there were nine felony arrests for drug offenses, and hundreds of trespass orders were issued.  Prosecutor Mat Heck said, “People from all across the Miami Valley came to these apartments for prostitutes and drugs.  It literally had become a supermarket for illegal activity.  The residents of that area should know we will not tolerate such behavior and are going to assist them in taking back their neighborhood.”
